Agreement to Terms

Welcome to Birdie's Pro Turf Care. By accessing our website or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you and Birdie's Pro Turf Care ("Company," "we," "us," or "our") regarding your use of our lawn care and landscape services.

Services Overview

Birdie's Pro Turf Care provides professional lawn care and landscape services, including but not limited to:

  • Robotic lawn mowing services and equipment installation
  • Smart irrigation system installation and management
  • Custom fertilization and agronomy programs
  • Tree health care, including injections and pest management
  • Premium sod installation and lawn renovation

Services are provided to residential and commercial properties in Denton, Highland Village, Flower Mound, and surrounding North Texas communities.

Service Agreements and Scheduling

Consultations

Initial consultations are provided to assess your property and recommend appropriate services. Consultation scheduling is subject to availability. We reserve the right to decline service requests at our discretion.

Service Proposals

Following consultation, we will provide a detailed service proposal outlining scope of work, pricing, and timeline. Services begin upon acceptance of the proposal and receipt of any required deposit.

Scheduling and Access

You agree to provide reasonable access to your property during scheduled service times. If access is restricted or obstructed (locked gates, aggressive pets, etc.), services may be delayed or rescheduled at your expense.

Pricing and Payment

Service Pricing

Pricing is based on property size, service type, frequency, and current market conditions. Quoted prices are valid for 30 days unless otherwise specified. We reserve the right to adjust pricing with 30 days' notice for ongoing service agreements.

Payment Terms

  • One-time services: Payment due upon completion unless otherwise agreed
  • Recurring services: Invoices sent monthly; payment due within 15 days
  • Equipment installation: 50% deposit required; balance due upon completion
  • Accepted payment methods: Credit card, ACH transfer, check

Late Payments

Accounts over 30 days past due may be subject to a 1.5% monthly late fee and suspension of services. We reserve the right to pursue collection for unpaid balances.

Cancellations and Refunds

Service Cancellations

Scheduled services may be cancelled or rescheduled with at least 48 hours' notice at no charge. Cancellations with less than 48 hours' notice may be subject to a cancellation fee equal to 50% of the scheduled service cost.

Ongoing Service Termination

Either party may terminate ongoing service agreements with 30 days' written notice. You remain responsible for payment of services provided through the termination date.

Refund Policy

If you are unsatisfied with service quality, notify us within 7 days for remediation. We will re-perform the service at no additional charge or provide a prorated refund at our discretion. Deposits for equipment installation are non-refundable once installation has begun.

Property Responsibilities

Property Condition

You are responsible for disclosing any hazards, underground utilities, irrigation systems, or property conditions that may affect service delivery. We are not liable for damage to unmarked or undisclosed property features.

Pre-Service Preparation

You agree to:

  • Remove obstacles (toys, furniture, hoses) from service areas
  • Secure pets indoors or away from work areas
  • Clearly mark any sensitive plants or landscape features
  • Notify us of any recent landscape changes or additions

Equipment Installation Services

Robotic Mowers and Irrigation Systems

Equipment installation services include professional setup, calibration, and initial training. Equipment is warrantied by the manufacturer; we facilitate warranty claims but are not responsible for manufacturer defects.

Post-Installation Support

We provide ongoing support for equipment we install as part of annual maintenance agreements. Support for equipment installed by others is available at standard service rates.

Chemical Applications and Safety

All chemical applications (fertilizers, herbicides, fungicides, insecticides) are performed by Texas Department of Agriculture licensed applicators. We follow all label requirements and industry best practices.

Following chemical applications:

  • Keep pets and children off treated areas as specified on notification flags
  • Typically 24-48 hours for most applications
  • Irrigation restrictions apply; we will provide specific guidance
  • Notify us immediately if you or your pets experience adverse reactions

Limitation of Liability

To the fullest extent permitted by law, Birdie's Pro Turf Care's liability for any claim arising from our services is limited to the amount paid for the specific service giving rise to the claim.

We are not liable for:

  • Damage caused by weather events, pests, disease, or natural occurrences
  • Pre-existing property conditions or hidden defects
  • Damage to unmarked or improperly located utilities, irrigation, or landscape features
  • Consequential, indirect, or incidental damages
  • Plant material loss due to factors beyond our control (drought, freeze, etc.)

We maintain general liability insurance in accordance with Texas business requirements.

Weather and Service Delays

Services may be delayed or rescheduled due to weather conditions (rain, extreme heat, freeze) that make service inadvisable or unsafe. We will reschedule at the earliest practical date. No refunds are provided for weather-related delays.

Intellectual Property

All content on our website, including text, images, logos, and design elements, is the property of Birdie's Pro Turf Care and protected by copyright and trademark laws. You may not use, reproduce, or distribute our content without written permission.

Dispute Resolution

Informal Resolution

In the event of a dispute, both parties agree to first attempt informal resolution by contacting us directly at (972) 849-4147.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any legal action must be brought in the courts of Denton County, Texas.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to active service customers. Continued use of services after changes constitutes acceptance of modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
